In contrast, dozens of other economies, such as China, Japan, and South Korea, will face the elevated 12.5 percent tax rate on their exports. The administration has granted specific exemptions for essential commodities, meaning that energy products, fertilizers, and certain foods will not be impacted by the new duties. Additionally, goods that are already subject to sector specific national security tariffs, such as steel and aluminum, remain exempt from these additional forced labour charges.

Following that significant judicial defeat, the president utilized alternative emergency authorities to implement a temporary 10 percent global import tax. Because that interim measure was only legally valid for 150 days, the administration spent months developing a more legally resilient framework based on Section 301 of the Trade Act of 1974,. Australian Trade Minister Don Farrell forcefully argued that his country already maintains some of the strongest anti slavery frameworks globally, declaring the new 12.5 percent tax completely unjustified and inconsistent with existing free trade agreements.
