ExxonMobil and Suncor Energy Challenge Boulder Climate Litigation at Supreme Court

WASHINGTON, D.C. / RankWire.AI / – The U.S. Supreme Court has taken up a significant climate lawsuit originating from Boulder, Colorado. The case hinges on whether federal statutes prevent states from pursuing claims related to greenhouse gas emissions. ExxonMobil and Suncor Energy are requesting the Court to halt the progress of the case under Colorado law. The justices also discussed whether they possess the authority to hear the case now. The oral arguments occurred on October 5, coinciding with the start of the Court’s 2026 term.

In 2018, Boulder County and the City of Boulder initiated the lawsuit, seeking damages for climate-related expenses they attribute to fossil fuel consumption. The complaint additionally accuses the defendants of misleading the public regarding climate risks. ExxonMobil and Suncor Energy deny these allegations, asserting that states lack the authority to impose liability for global emissions through their own laws. The case has yet to go to trial on the core liability issues.

A decision by the Colorado Supreme Court in May 2025 found that federal law does not preempt Boulder’s claims, allowing the lawsuit to proceed within state courts. The U.S. Supreme Court agreed to review the matter in February 2026. It also requested the parties to address whether federal law and Article III confer jurisdiction. The case is listed on the docket as Suncor Energy (U.S.A.) Inc. v. County Commissioners of Boulder County, No. 25-170.

Federal legislation underpins the legal debate

Representatives for the companies argued that federal law governs interstate pollution and global climate issues, citing the Clean Air Act and restrictions on applying one state’s laws beyond its borders. The U.S. government supported their position as an amicus curiae, contending that federal law bars the state claims in question. The companies emphasized that Boulder’s claims involve conduct and emissions occurring outside Colorado’s borders, focusing on federal regulation over interstate pollution.

Lawyers for Boulder countered that states are permitted to seek remedies for injuries that happen within their borders. They maintained that the lawsuit extends beyond regulating emissions to include allegations related to marketing, concealment, and other conduct involving fossil fuel products. Boulder also argued that the Clean Air Act does not negate those state remedies. During the hearing, justices questioned both sides about preemption, state authority, and jurisdiction, referencing previous Supreme Court rulings on interstate pollution issues.

Eight justices deliberate on the case

Justice Samuel Alito did not participate, leaving eight justices to consider the case. The transcript reveals extensive questioning on jurisdictional matters before the justices moved to the substantive issues. They examined the scope of the Clean Air Act and the distribution of power between state and federal authorities, but no ruling was issued at that time. The Court has yet to announce a decision date. The Colorado ruling remains in effect as the federal case advances through the courts.

The Supreme Court’s role is to determine whether federal law prevents Boulder from pursuing these claims under state law. It is not deciding whether ExxonMobil or Suncor Energy is responsible for climate damages. Similar lawsuits by other state and local governments are ongoing across the country. This case primarily concerns federal preemption and the Court’s authority to review such disputes. The underlying allegations are still unresolved, and any final judgment will address the legal questions raised in this case.
